I think it's fair use, as per Jamesday's comment on Wikipedia:Possible copyright infringements on February 4, 2004 on the question whether a thumbnail of a movie poster was a copyvio:
- "These will always be fair use here in articles about the movie. There's no prospect of a thumbnail image like these replacing the sales of the video or of posters of the video cover art and since the purpose of the cover art is promotional any exposure is likely to increase sales."
For the record, the poster itself is © by the Montreux Jazz Festival. I believe the use of this thumbnail is fair use.
